TERMS AND CONDITIONS
1. Introduction and Acceptance
These Terms and Conditions (“Terms”) govern the access to and use of the website
www.lakshmikendra.org (including its alias domains www.lakshmikendra.com, which
redirect to the primary domain) and all content, services, products, and payment facilities
offered through it (collectively, the “Platform”). The Platform is owned and operated by
Lakshmikendra, having its registered office at P.O.: Sri Mayapur, District Nadia, West
Bengal – 741313 (“we”, “us”, “our”, or the “Trust”).
By registering on, accessing, browsing, or transacting through the Platform, you (“you”,
“your”, or the “User”) agree to be bound by these Terms, our Privacy Policy, Refund Policy,
and Cancellation Policy, each of which is incorporated herein by reference. If you do not
agree to these Terms, please do not use the Platform. These Terms constitute an electronic
record within the meaning of the Information Technology Act, 2000 and the rules made
thereunder, and do not require any physical or digital signature.
2. Eligibility and Registered Access
Use of the Platform is restricted to registered users. Access to member areas, purchase
facilities, and donation facilities is available only upon registration and approval of a user
account. You must be at least eighteen (18) years of age and competent to contract under the
Indian Contract Act, 1872 to register or transact on the Platform. By registering, you
represent that all information furnished by you is true, accurate, current, and complete, and
you undertake to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all
activities occurring under your account. You must notify us immediately of any unauthorised
use of your account. We reserve the right to suspend or terminate any account, or to refuse
registration, at our discretion, including for breach of these Terms.
3. Nature of the Platform
The Platform facilitates two categories of transactions:
• Sales: the purchase of devotional goods, books, media, seva items, and other products
or services listed on the Platform from time to time (“Products”); and
• Donations: voluntary contributions made to the Trust in furtherance of its charitable
and religious objects (“Donations”).
Product listings, descriptions, images, and prices are indicative and subject to change without
notice. We endeavour to ensure accuracy but do not warrant that all descriptions or prices are error-free. In the event of a pricing or listing error, we reserve the right to cancel the affected
order and refund any amount paid, in accordance with our Refund Policy.
4. Donations
All Donations made through the Platform are voluntary and are made without coercion,
solicitation of any prohibited nature, or expectation of goods or services in return. Donations
shall be applied towards the charitable and religious objects of the Trust at the discretion of
its Trustees.
Where the Trust holds valid registration under Section 80G of the Income-tax Act, 1961,
donors who are Indian taxpayers may be eligible for deduction in respect of their Donations,
subject to the provisions of that Act. A receipt containing the particulars required under
applicable law will be issued to the registered email address of the donor. Donors are
responsible for providing accurate name and PAN details for such receipts. The Trust does
not accept anonymous donations through the Platform and does not accept foreign
contributions through the Platform unless and to the extent permitted under the Foreign
Contribution (Regulation) Act, 2010 and its registration status thereunder.
5. Pricing and Payment
All prices and donation amounts are denominated in Indian Rupees (INR) and are inclusive
of applicable taxes unless expressly stated otherwise. Payments on the Platform are processed
through secure, RBI-authorised payment gateway and banking channels. By making a
payment, you authorise us and our payment service providers to charge the payment
instrument selected by you.
We do not collect or store your card numbers, CVV, net-banking credentials, UPI PIN, or
other sensitive payment credentials on our servers. Such data is handled directly by the
payment gateway and the acquiring bank in accordance with the directions of the Reserve
Bank of India, including its guidelines on payment aggregators and card-on-file tokenisation.
A transaction is complete only upon receipt of a successful payment confirmation from the
payment gateway. In case of a failed, declined, or pending transaction where an amount has
nonetheless been debited, the provisions of our Refund Policy shall apply.
6. Order Acceptance, Shipping and Delivery
Your placement of an order constitutes an offer to purchase, which we may accept or decline.
Acceptance occurs upon our despatch of the Products or, in the case of digital goods or
services, upon provision of access. Estimated delivery timelines communicated on the
Platform are indicative. Title and risk in Products pass to you upon delivery. Detailed terms
of dispatch and delivery are set out in our Shipping and Delivery Policy.
7. Permitted Use and Prohibited Conduct
You agree to use the Platform only for lawful purposes and in a manner consistent with its
devotional and charitable character. You shall not:
• use the Platform in violation of any applicable law, including the Information
Technology Act, 2000 and rules thereunder;
• impersonate any person, misrepresent your identity, or furnish false information;
• upload or transmit any material that is unlawful, defamatory, obscene, hateful, infringing, or otherwise objectionable;
• attempt to gain unauthorised access to the Platform, other users’ accounts, or connected
systems, or introduce viruses or other harmful code;
• scrape, harvest, or copy Platform content or user data by automated means; or
• use the payment facilities for money laundering, third-party payment processing, or any
purpose other than bona fide purchases and Donations.
8. Intellectual Property
All content on the Platform, including text, images, artwork, audio, video, logos, and
software, is the property of the Trust or its licensors and is protected under applicable
copyright, trademark, and other intellectual property laws. No content may be reproduced,
distributed, or exploited for commercial purposes without our prior written consent. Limited
personal, non-commercial use for devotional purposes is permitted.
9. Disclaimer of Warranties
The Platform and all content and services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied,
including warranties of merchantability, fitness for a particular purpose, and non-
infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free.
Nothing in these Terms limits any rights you may have under the Consumer Protection Act,
2019 that cannot be limited by contract.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Trust, its trustees, officers,
employees, and volunteers shall not be liable for any indirect, incidental, special,
consequential, or punitive damages arising out of or in connection with the use of the
Platform. Our aggregate liability in respect of any transaction shall not exceed the amount
actually paid by you for that transaction.
11. Indemnity
You agree to indemnify and hold harmless the Trust, its trustees, officers, employees, and
agents from and against all claims, liabilities, damages, losses, and expenses (including
reasonable legal fees) arising out of your breach of these Terms, your violation of any law or
the rights of any third party, or your misuse of the Platform.
12. Suspension and Termination
We may suspend or terminate your access to the Platform, in whole or in part, at any time,
with or without notice, for breach of these Terms, suspected fraudulent or unlawful activity,
or as required by law or by our banking and payment partners. Provisions which by their
nature ought to survive termination (including Sections 8 to 11 and 14) shall so survive.
13. Amendments
We may revise these Terms from time to time. The revised Terms will be published on this
page with an updated “Last updated” date and shall apply prospectively. Your continued use
of the Platform after publication constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Subject to any mandatory provisions of the Consumer Protection Act, 2019, the courts at
[Krishnagar, District Nadia, West Bengal / city of registered office] shall have exclusive
jurisdiction over all disputes arising out of or in connection with these Terms or the use of the
Platform.

acknowledged within twenty-four (24) hours and disposed of within fifteen (15) days of
receipt.
